Privacy Policy

How Migration Star collects, uses, stores and shares personal information, including information you give us through our website, our forms and our candidate board.

1. Who we are

Migration Star is an Australian migration agency. Immigration assistance is provided by Rohit Sharma, Registered Migration Agent, MARN 1797395, and by other registered migration agents engaged by Migration Star. Our office is at Level 2, 8 Clunies Ross Court, Eight Mile Plains QLD 4113. In this policy, "we", "us" and "our" mean Migration Star.

We are bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth), by the Code of Conduct for registered migration agents, and by the record-keeping obligations that apply to registered migration agents under the Migration Act 1958 (Cth) and the Migration Agents Regulations 1998 (Cth).

2. What personal information we collect

The information we collect depends on how you deal with us. It may include:

  • Identity and contact details: your name, date of birth, email address, phone number, postal address, nationality and passport details.
  • Immigration details: your current visa, visa history, immigration correspondence, and information about your circumstances that is relevant to a visa application.
  • Education and employment details: qualifications, transcripts, English test results, skills assessments, employment history, references and your CV or resume.
  • Family and relationship details where they are relevant to an application, for example for partner or dependant visas.
  • Financial details relevant to an application, such as evidence of funds, and payment details when you pay our fees. Card payments are processed by our payment provider and we do not store full card numbers.
  • Sensitive information, such as health or criminal record information, where a visa application requires it. We collect sensitive information only with your consent or where the law requires or permits it.
  • Business details if you are an employer: business name, ABN, contact people, the positions you wish to fill and your sponsorship history.
  • Website information: pages visited, forms submitted, the device and browser you used, and cookie data as described below.

We collect this information directly from you through our website forms, by email, phone, WhatsApp and in meetings, and from documents you provide. We may also collect it from third parties with your authority, for example from the Department of Home Affairs, education providers, employers, assessing authorities or your previous representative.

3. Why we collect and use it

  • To assess your circumstances and provide immigration assistance and advice.
  • To prepare and lodge visa, sponsorship, nomination and review applications on your behalf, and to communicate with the Department of Home Affairs, the Administrative Review Tribunal and other bodies about them.
  • To respond to your enquiries, book and manage consultations, and send you information you have asked for.
  • To operate the candidate board described in section 4.
  • To issue invoices, take payment and keep the financial records the law requires us to keep.
  • To comply with our obligations as registered migration agents, including client file and record-keeping requirements.
  • To send you marketing about our services where you have agreed to receive it. You can opt out at any time.

4. The candidate board

If you register with us as a candidate seeking employer sponsorship, we ask for your consent to publish an anonymised profile on our candidate board. The anonymised profile shows your occupation, years of experience, country of citizenship, current location, visa status, qualification level, English level and availability under a reference number. It does not show your name, photograph, contact details or CV.

If an employer expresses interest in your profile, we contact you, tell you who the employer is and what the position involves, and ask whether you consent to be introduced. We share your CV and contact details with an employer only after you have given that consent for that employer. You can decline any introduction, and you can withdraw from the board at any time by emailing us. Your card is removed within two business days of a withdrawal request.

Registration on the candidate board is free. We do not charge candidates or employers for introductions. Registration is not a job offer, an employment contract or a visa application, and we do not guarantee that any employer will make an offer or that any visa will be granted. Migration Star is a registered migration agency and is not a recruitment agency, a labour hire provider or an employer.

If you are an employer using the board, we collect your business and contact details and the details of the positions you wish to fill, and we share candidate information with you only in the way described above.

5. Who we share your information with

  • The Department of Home Affairs, the Administrative Review Tribunal, and other Australian and overseas government bodies, when required to progress your application or as required by law.
  • Skills assessing authorities, education providers, English test providers, health providers and translators, where needed for your application.
  • Employers and candidates, in the circumstances and with the consents described in section 4.
  • Our service providers who help us run our business, including our customer relationship management system (HubSpot), email and document storage (Microsoft 365), payment processing, and website hosting. These providers may only use your information to provide services to us.
  • Our professional advisers, insurers and the Office of the Migration Agents Registration Authority, where required.
  • Anyone you authorise us to share it with.

We do not sell personal information.

6. Where your information is stored and how we protect it

We store client information in our customer relationship management and document systems. Our HubSpot account is hosted in HubSpot's Asia-Pacific data centre in Australia, and our Microsoft 365 tenancy is hosted in Australia. Some of our service providers, and some government bodies and overseas authorities we deal with on your behalf, may store or access information outside Australia, including in the United States, the European Union, India, the Philippines and Papua New Guinea, depending on your matter. Where we disclose information overseas we take reasonable steps to ensure it is handled in accordance with Australian privacy law.

We protect personal information with access controls, multi-factor authentication, encryption in transit and staff confidentiality obligations. We keep client files for at least seven years after a matter ends, as required of registered migration agents, and then securely destroy or de-identify them unless the law requires longer retention.

7. Marketing, cookies and website analytics

If you give us your details through a form or enquiry, we may send you information about our services and about Australian migration developments that are relevant to you. Every marketing email contains an unsubscribe link, and you can ask us to stop at any time.

Our website uses cookies and similar technologies, including HubSpot tracking and analytics cookies, to remember your preferences, understand how the site is used and measure our marketing. You can control cookies through your browser settings and through the cookie banner on our website. Blocking some cookies may affect how the site works.

8. Access, correction and complaints

You can ask us for access to the personal information we hold about you and ask us to correct it if it is inaccurate, out of date or incomplete. We will respond within a reasonable time and usually within 30 days. In limited cases the law allows us to refuse access, and if so we will tell you why.

If you believe we have mishandled your personal information, please contact us first using the details below and we will investigate and respond in writing. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au. Complaints about the conduct of a registered migration agent can also be made to the Office of the Migration Agents Registration Authority at mara.gov.au.
